BY USING AND/OR VISITING THE THIS WEBSITE (collectively, including all Content and Services available through the myFavz.com domain name, the "myFavz Website", “myFavz network” “myFavz facebook application” or "Website"), YOU SIGNIFY YOUR ASSENT TO BOTH THESE TERMS AND CONDITIONS (the "Terms of Service") AND THE TERMS AND CONDITIONS OF MYFAVZ'S PRIVACY NOTICE, WHICH ARE PUBLISHED AT http://www.MyFavz.com/privacy/, AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. If you do not agree to any of these terms, then please do not use the MyFavz content and services.
These Terms of Service and the privacy policy apply to all users of the myFavz Website and myFavz Network, including users who are also contributors of text, image, audio, video or interactive content, information, and other materials or services on the Website. The myFavz Website may contain links to third party websites that are not owned or controlled by myFavz, over which myFavz has no control and assumes no responsibility for, the content, privacy policies, or practices of any third party websites. In addition, myFavz will not and cannot censor or edit the content of any third-party site. By using the Website, you expressly relieve myFavz from any and all liability arising from your use of any third-party website. Accordingly, we encourage you to be aware when you leave the myFavz Website and to read the terms and conditions and privacy policy of each other website that you visit.
myFavz also allows Users to send and receive anonymous messages for the purpose of finding gift ideas.These messages are partially anonymous, as the identity of the user sending the message is eventually disclosed to the user receiving the anonymous message on a pre-determined date in the near future , which could be the date of the event, i.e. birthday of the recipient, christmas,etc The extent to which your anonymity is protected is stated in our Privacy Policy. Subject to the limitations herein, we allow any member of the website and its network to use myFavz within his or her Facebook account or the myFavz website and/or network. Please read this Agreement carefully as it contains important information regarding your legal rights, remedies and obligations OUR PRIVACY POLICY.
Important Note: Anonymous messages on myFavz can be fun, and enables you to share gifting related information with each other. However, certain individuals may abuse a lack of accountability to send messages that are upsetting, frightening, harassing or insulting. We urge you to act responsibly, and to refrain from either sending such messages or encouraging anyone to send them to you. IF AT ANY TIME YOU RECEIVE AN UPSETTING, DISTURBING, FRIGHTENING OR HARASSING MESSAGE, PLEASE DO THE FOLLOWING:

  1. DO NOT RESPOND IN ANY WAY—A NON-RESPONSE TO A DISTURBING MESSAGE IS THE BEST WAY TO DISCOURAGE ITS SENDER;
  2. CLICK ON "IGNORE USER" (This will prevent you from receiving anonymous messages from the person with that ID; also, we block from MyFavz any user that is "ignored" by multiple Users); AND
  3. IF YOU WISH NEVER TO RECEIVE SUCH MESSAGES FROM ANYONE, DELETE YOUR ACCOUNT ON MYFAVZ.COM AND/OR REMOVE MYFAVZ FROM YOUR FACEBOOK ACCOUNT IMMEDIATELY.

In all but the most severe cases, the above actions should be sufficient, and you will not need to proceed any further. However, if a specific message or series of messages sinks to the level of criminal activity—i.e., someone threatens you with serious bodily harm, or engages in criminal stalking or harassment—please review the procedures for reporting such a message.
By using myFavz, including but not limited to, adding it to your Facebook account, viewing messages people have written to you, writing messages to other Users or replying to messages Users have sent you, you agree, without limitation or qualification, to be bound by, and to comply with, these Terms of Use, our Privacy Policy, Facebook's Platform Application Terms of Use, Facebook's Terms of Use, Facebook's Privacy Policy, Shopping.com’s Terms and Conditions, Amazon.com’s Terms and Conditions, and with any other posted guidelines or rules applicable to any feature or service in connection with myFavz, such as our Frequently Asked Questions. If you don't agree to any part of these Terms of Use, please do not add or use myFavz in any way. Where the terms contained in this Agreement differ from the Facebook Platform Application Terms of Use, Facebook Terms of Use or Facebook Privacy Policy, the terms contained in this Agreement shall govern and control your use of myFavz.

  1. Amendments to this Agreement.

We reserve the right to change these Terms of Use and any other MyFavz guidelines at any time. Any modification to this Agreement will become effective immediately upon posting. You will be responsible to check this Agreement from time to time to see if there are any changes to it that might affect your use. Continued use of MyFavz after any such change will constitute acceptance of all changes. If you do not agree with these Terms of Use as they may be amended, you must immediately terminate your use of MyFavz and remove it from your Facebook account.

  1. Definitions.

"Agreement" or "Terms of Use" means this document, the MyFavz Terms of Use, as it may be amended, modified or changed in anyway from time to time.
"MyFavz" means Magic & Miracle's myFavz.com website, MyFavz Facebook Platform Application, and network which includes any Content, service, or property accessible in connection with Magic & Miracle's MyFavz Facebook Platform Application and/or myFavz.com webite and network, whether appearing on our MyFavz Web site, your Facebook account or profile, the Facebook account or profile of any Users, or Content sent to Facebook users who have not yet added the MyFavz, in which case those messages are stored on our servers and will appear on the Facebook user’s profile when they add MyFavz. This includes, but isn't restricted to, all text, images, and software.
" MyFavz Facebook Platform Application " means http://apps.facebook.com/myFavz/.
“myFavz website” means http://www.myfavz.com/
"Facebook" is defined in the Facebook Terms of Use
"Facebook Platform Application" means "Platform Applications", as that term is defined in the Facebook Platform Application Terms of Use, and means generally an application developed by Facebook or a third-party on the Facebook Platform.
"Content" means any content, service, property or materials, including advertising, features or groups of features or data that are visible to Users or transmitted between Users of MyFavz or by a User of MyFavz to a Facebook user, but only through MyFavz, including all sent and received messages, discussions, images, text, software and other content located or otherwise displayed within MyFavz, whether generated by Users or by MyFavz.
"Magic & Miracle," “myFavz” “myFavz.com” "we," "us," or "our" refer to Magic & Miracle Ventures LLC., a Massachussetts based Company.
"Users" or "you" as used herein refer collectively to any myFavz and/or Facebook users who add MyFavz to their Facebook account, any myFavz and/or Facebook users who send messages to other Users, any myFavz and/or Facebook users who receive messages from other Users, or any myFavz and/or Facebook users who reply to messages that were sent to them from other Users.

3. Your License

MyFavz is intended for personal use by individuals to allow them to send and receive partially anonymous messages to find the perfect gift for friend or family. Any unauthorized, commercial use of MyFavz or resale, repurposing, or reproduction of our services or Content of MyFavz is expressly prohibited. This includes providing links to specific Content related pages other than to the MyFavz Web Site for any commercial purpose that has not been specifically authorized by us in writing as well as using MyFavz to contact other users for commercial purposes You agree not to attempt to, or encourage others to, bypass the authentication and security mechanisms maintained by us or to reverse engineer the software that runs MyFavz including, without limitation, not to post messages on the MyFavz Web Site, either in the public comments section or elsewhere, that relate to, describe or include a hyperlink to another Web page that in any way discusses bypassing MyFavz's authentication and security mechanisms or discusses reverse engineering the software that runs MyFavz.

MyFavz Facebook Application is dependent for its existence on Facebook. In the event that Facebook changes its application or its policies or procedures, we reserve the right to cancel your use of MyFavz and/or amend this Agreement to accord the use of MyFavz with Facebook.
You agree not to use any stratagem, means, code or other device to circumvent the anonymity provided by MyFavz, or to otherwise discern or allow the discernment by others of the identities of our Users. A. MyFavz hereby grants you permission to use the Website as set forth in this Terms of Service, provided that without limiting the foregoing, you agree that you will not use our sites to take any of the following actions:

  • Defame, abuse, harass, stalk, threaten, or otherwise violate the legal right of others;
  • Publish, post, upload, e-mail, distribute, or disseminate (collectively, "Transmit") any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content;
  • Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, our sites, any software or hardware, or telecommunications equipment;
  • Advertise or offer to sell any goods or services for any commercial purpose unless you have our written consent to do so;
  • Transmit surveys, contests, pyramid schemes, spam, unsolicited advertising or promotional materials, or chain letters;
  • Download any file that you know or reasonably should know cannot be legally obtained in such manner;
  • Falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material;
  • Restrict or inhibit any other user from using and enjoying any public area within our sites;
  • Collect or store personal information about other end users;
  • Interfere with or disrupt our sites, servers, or networks;
  • Impersonate any person or entity, including, but not limited to, a myFavz representative, or falsely state or otherwise misrepresent your affiliation with a person or entity;
  • Forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through our sites or to manipulate your presence on our sites;
  • Take any action that imposes an unreasonably or disproportionately large load on our infrastructure;
  • Engage in any illegal activities.

You will otherwise comply with the terms and conditions of these Terms of Service.
If you choose a screen name that, in our sole discretion, is obscene, indecent, abusive or that might otherwise subject us to public disparagement or scorn, we reserve the right, without prior notice to you, to automatically change your screen name, delete your posts from our sites, deny you access to our sites, or any combination of these actions.
The technology and the software underlying our Website and the Services is the property of MyFavz, our affiliates, and our partners. You agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying our sites or the Services. You agree not to modify the software underlying our sites in any manner or form or to use modified versions of such software, including (without limitation) for the purpose of obtaining unauthorized access to our sites.
B. In order to access some features of the Website, you will have to create an account. You may never use another's account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify MyFavz immediately of any breach of security or unauthorized use of your account. You also acknowledge that failure to exit from your accounts at the end of each session may result in unauthorized use of your accounts. We will not be responsible for any loss or damage that may result if you fail to comply with these requirements. Although MyFavz will not be liable for your losses caused by any unauthorized use of your account, you may be liable for the losses of MyFavz or others due to such unauthorized use.
C. You agree not to use or launch any automated system, including without limitation, "robots," "spiders," "offline readers," etc., that accesses the Website in a manner that sends more request messages to the myFavz servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, myFavz grants the operators of public search engines permission to use spiders to copy materials from the site for the sole purpose of creating publicly available searchable indices of the materials, but not caches or archives of such materials. myFavz reserves the right to revoke these exceptions either generally or in specific cases. You agree not to collect or harvest any personally identifiable information, including account names, from the Website, nor to use the communication systems provided by the Website for any commercial solicitation purposes. You agree not to solicit, for commercial purposes, any users of the Website with respect to their User Submissions.

4. Intellectual Property Rights.

The content on the myFavz Website, except all User Submissions (as defined below), including without limitation, the text, software, scripts, graphics, photos, sounds, music, videos, interactive features and the like ("Content") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to myFavz, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Content on the Website is provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. myFavz reserves all rights not expressly granted in and to the Website and the Content. You agree to not engage in the use, copying, or distribution of any of the Content other than expressly permitted herein, including any use, copying, or distribution of User Submissions of third parties obtained through the Website for any commercial purposes. If you download or print a copy of the Content for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the MyFavz Website or features that prevent or restrict use or copying of any Content or enforce limitations on use of the MyFavz Website or the Content therein.

5. User Submissions

A. The myFavz Website may now or in the future permit the submission of text, images, audio, videos, interactive or other communications submitted by you and other users ("User Submissions") and the hosting, sharing, and/or publishing of such User Submissions. You understand that whether or not such User Submissions are published, MyFavz does not guarantee any confidentiality with respect to any submissions.
B. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that: (i) you own or have the necessary licenses, rights, consents, and permissions to use and authorize MyFavz to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service; and (ii) you have the written consent, release, and/or permission of each and every identifiable individual person in the User Submission to use the name or likeness of each and every such identifiable individual person to enable inclusion and use of the User Submissions in the manner contemplated by the Website and these Terms of Service. For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to MyFavz, you hereby grant MyFavz a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the MyFavz Website and MyFavz's (and its successor's) business, including without limitation for promoting and redistributing part or all of the MyFavz Website (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the MyFavz Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Service. The foregoing license granted by you terminates once you remove or delete a User Submission from the MyFavz Website.
C. In connection with User Submissions, you further agree that you will not: (i) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant MyFavz all of the license rights granted herein; (ii) publish falsehoods or misrepresentations that could damage MyFavz or any third party; (iii) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, violate any law, or is otherwise inappropriate; (iv) post advertisements or solicitations of business: (v) impersonate another person. MyFavz does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and MyFavz expressly disclaims any and all liability in connection with User Submissions. MyFavz does not permit copyright infringing activities and infringement of intellectual property rights on its Website, and MyFavz will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights. MyFavz reserves the right to remove Content and User Submissions without prior notice. MyFavz will also terminate a User's access to its Website, if they are determined to be a repeat infringer. A repeat infringer is a User who has been notified of infringing activity more than twice and/or has had a User Submission removed from the Website more than twice. MyFavz also reserves the right to decide whether Content or a User Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. MyFavz may remove such User Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.
D. In particular, if you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
(i) A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
(ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
(iii) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the MyFavz to locate the material;
(iv) Information reasonably sufficient to permit the MyFavz to contact you, such as an address, telephone number, and, if available, an electronic mail;
(v) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(vi) A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

For clarity, only DMCA notices should go to the Copyright Agent; any other feedback, comments, requests for technical support, and other communications should be directed to MyFavz customer service through http://www.MyFavz.com/contact/. You acknowledge that if you fail to comply with all of the requirements of this Section 5(D), your DMCA notice may not be valid.
E. You understand that when using the MyFavz Website, you will be exposed to User Submissions from a variety of sources, and that MyFavz is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against myFavz with respect thereto, and agree to indemnify and hold myFavz, its Owners/Operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.
F. MyFavz reserves the right to discontinue any aspect of the myFavz Website at any time

  1. User Disputes.

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS. WE RESERVE THE RIGHT, BUT HAVE ABSOLUTELY NO OBLIGATION TO DELETE MESSAGES THAT WE DEEM IN OUR SOLE DISCRETION TO BE OFFENSIVE OR DISCLOSE THE IDENTITY OF A USER TO ANOTHER USER, INDIVIDUAL OR ENTITY, EXCEPT IF DIRECTED TO DO SO BY A COURT OF COMPETENT JURISDICTION, AS FURTHER PROVIDED IN OUR PRIVACY POLICY.

7. Warranty Disclaimer

YOU AGREE THAT YOUR USE OF THE MYFAVZ WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, MYFAVZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. MYFAVZ MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SITE'S CONTENT OR THE CONTENT OF ANY SITES LINKED TO THIS SITE AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE MYFAVZ WEBSITE. MYFAVZ DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR ANY PRODUCT OR SERVICE ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE MYFAVZ WEBSITE OR ANY HYPERLINKED WEBSITE OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND MYFAVZ WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF PRODUCTS OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.

8. Limitation of Liability

IN NO EVENT SHALL MYFAVZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER RESULTING FROM ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR WEBSITE, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM OUR WEBSITE, (IV) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE, WHICH MAY BE TRANSMITTED TO OR THROUGH OUR WEBSITE BY ANY THIRD PARTY, AND/OR (V) ANY ERRORS OR OMISSIONS IN ANY CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF YOUR USE OF ANY CONTENT POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE MYFAVZ WEBSITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. WE WILL BEAR NO LIABILITY FOR ANY PRODUCTS OR SERVICES PROVIDED HEREUNDER, INCLUDING ANY LIABILITY FOR NEGLIGENCE. IN NO EVENT SHALL EITHER PARTY BE LIABLE TO THE OTHER FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES, INCLUDING WITHOUT LIMITATION LOST PROFITS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH POTENTIAL LOSS OR DAMAGE. THE FOREGOING LIMITATION OF LIABILITY AND EXCLUSION OF CERTAIN DAMAGES SHALL APPLY REGARDLESS OF THE SUCCESS OR EFFECTIVENESS OF OTHER REMEDIES.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO SOME USERS. MyFavz makes no representations that the MyFavz Website is appropriate or available for use in other locations. Those who access or use the MyFavz Website from other jurisdictions do so at their own volition and are responsible for compliance with local law.

10. Indemnity

You agree to defend, indemnify and hold harmless MyFavz, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the MyFavz Website; (ii) your violation of any term of these Terms of Service; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your User Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the MyFavz Website.

11. Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are over the age of 13, as the MyFavz Website is not intended for children under 13. 12. Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by MyFavz without restriction.
